1. Agreement to Terms

By accessing or using the DCA Markets platform, website, and related software tools (collectively, the "Interface"), you agree to be bound by these terms. If you do not agree to these terms, you must not access or use the Interface.

2. Nature of the Interface

DCA Markets is a web-based user interface that facilitates access to a decentralized protocol on the Solana blockchain. The Interface is distinct from the smart contracts and protocol it interacts with.

Non-Custodial

We do not have custody, possession, or control of your assets at any time. You retain sole control of your private keys and digital assets.

No Account Required

You do not create an account with us. You connect your wallet directly to the blockchain.

Software Provider

We provide software tools for transaction construction and broadcasting. We are not a broker, dealer, exchange, investment advisor, or custodian.

3. Eligibility & Prohibited Jurisdictions

You represent and warrant that you are NOT a citizen, resident, or physically present in:

  • Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk, and Luhansk regions of Ukraine.
  • Any jurisdiction where the use of this Interface would be illegal (a "Restricted Territory").

4. No Financial or Legal Advice

The information provided on the Interface does not constitute investment advice, financial advice, trading advice, or any other sort of advice.

Self-Directed Execution

All trades and strategies (including automated DCA settings and Smart DCA configurations) are executed automatically based on parameters you select. You are solely responsible for determining whether any investment, investment strategy, or related transaction is appropriate for you.

No Fiduciary Duty

There is no fiduciary relationship between you and DCA Markets.

5. Assumption of Risk

By using the Interface, you acknowledge and accept the risks associated with cryptographic systems and the Solana blockchain, including but not limited to:

  • Martingale Logic Risk: The automated buying engine is designed to increase buy sizes as prices drop. You acknowledge that if an asset price does not recover, this strategy may result in accelerated losses.
  • Token Risk: DCA Markets supports any token that trades on Solana via Jupiter. The availability of a token on the platform does not constitute an endorsement by DCA Markets. You accept that tokens may be highly volatile or lose all value.
  • Smart Contract Risk: Bugs, malfunctions, or exploits in the protocol code.
  • Blockchain Risk: Chain halts, congestion, or high transaction fees (gas) that may delay or fail transactions.
  • Market Risk: Extreme volatility and the potential for total loss of funds.
  • Regulatory Risk: Changes in laws and regulations that may impact the utility or legality of crypto assets.

6. Fees & Incentives

Protocol Fees

You agree to pay the applicable protocol fee on transactions: 0.1% for single swaps and basic DCA orders, and 0.6% for Smart DCA orders. For Smart DCA orders, 55% of the fee is used to market-buy your target token and is added to your output. The remaining 45% goes to protocol operations.

Fee Injection

The mechanism whereby a portion of Smart DCA fees is used to purchase your target token is an automated software function, not a dividend or profit-sharing agreement. Using the platform does not entitle you to any portion of DCA Markets's corporate revenue.

Fee Changes

DCA Markets reserves the right to modify, increase, or decrease protocol fees at any time without prior notice.

7. Prohibited Activity

You agree not to use the Interface for any unlawful purpose, including but not limited to:

  • Money laundering, terrorist financing, or sanctions evasion.
  • Market manipulation (e.g., wash trading or spoofing).
  • Accessing the Interface from a jurisdiction where such use is prohibited by applicable law or regulation.

8. Limitation of Liability

To the maximum extent permitted by law, DCA Markets and its developers shall not be liable for any damages, direct or indirect, arising out of or in connection with your use of the Interface. The Interface is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

9. Indemnification

You agree to indemnify and hold harmless DCA Markets and its developers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Interface or your violation of these Terms.

10. Dispute Resolution & Class Action Waiver

Binding Arbitration

Any dispute arising out of or related to these Terms or the Interface shall be resolved through binding arbitration, rather than in court.

Class Action Waiver

You waive any right to participate in a class action lawsuit or class-wide arbitration. Disputes will be resolved on an individual basis only.

11. Modifications

We reserve the right to modify these terms at any time. Your continued use of the Interface following any changes constitutes your acceptance of the new terms.
